Schedule C

It is hereby agreed by this purchaser and all purchasers jointly and severally that the following shall be the basic and common rules for conduct between the purchasers with respect to maintenance of the interior and exterior of the entire project.

1 It is agreed by the purchasers that all shall maintain adequate fire and damage or loss insurance on their individually purchased units.

2 It is agreed that all purchasers shall have the exclusive and individual right to the maintenance, repair, remodel and or redecoration of the interior of their individually purchased homes.

3 It is agreed that no individual purchaser can change the colors of any exterior common frontage stucco, roofing, garage door, exterior unit entrance doors, fascia, gutter or trim without the common consent of at least 6 out of the eight purchasers.

4 It is agreed that in the event, over time, of the necessity to repair and or replace the roofing that it shall be done with the common consent of at least 6 out of the 8 purchasers and that no purchaser shall unreasonable withhold their consent upon obtaining an independent roofers inspection report. And that the cost of such repair and or replacement shall be equally born between the purchasers as a group. And this method shall be employed with respect to any and all such exterior maintenance and or repair and or replacements as the case may be.

5 It is agreed that in the event that damage to the roof over a particular unit or a broken window glass or such other event that causes damage to a specific unit that the insurance of that purchaser shall repair and or replace the specific damage as per their individual insurance provisions.

6 It is agreed that in the event of damage to a garage door or entry door that causes repair and or replacement that the costs shall be borne by the owner of the unit incurring damage and that any repair and or replacement shall be in the color and style and exact image of the common finishes of all other units with no exception allowed.

7 It is agreed that each purchaser shall maintain exterior light fixtures, lawns and flower beds, driveway, the cleaning of roof gutters, etc., with respect to their individual units with the sole exception of a joint agreement to have an independent contractor maintain such things as grass and flower beds, window cleaning, etc.

8 It is hereby agreed that in the event that a purchaser unreasonably withhold consent as herein specified that a consent of at least 6 of the 8 purchasers shall be deemed as consent to proceed by all.

9 It is agreed that maintenance and repair to the project perimeter fencing shall again be by common consent of at least 6 of the 8 purchasers and that the cost shall be equally shared by each of the eight purchasers.

10 It is agreed be all parties that access to the rear yards for the purposes of yard maintenance, grass cutting, window cleaning etc., shall be granted through either of the north and or south side access gates.

11 It is further agreed that the parties can add or remove conditions from this agreement by the common consent of 6 of the 8 purchasers/owners as the need arises or as agreed by common consent.
